It is important to note that Connecticut has some crucial laws to take into consideration when pursuing a personal injury claim:

Negligence and Fault

Like most other states, Connecticut follows a fault-based system for personal injury claims. If one or more parties are directly responsible for your injuries, you have a legal right to pursue a claim or claims for financial compensation (see Connecticut General Statutes § 52-572h).

This same statute states that contributory negligence (i.e., the claimant’s share of fault for his or her own injury) does not bar recovery of damages provided negligence on the part of the claimant is not greater “than the combined negligence of the person or persons against whom recovery is sought.” Damages are reduced in proportion to the claimant’s share of fault.

Unfortunately, until a settlement or trial award is obtained, you are responsible for your medical bills, medical care, and lost wages. It can be months or years before you are compensated, and you may not have the means to get the medical treatment you need. If you are without health insurance or have a large deductible, you may find that you cannot afford the treatment you need or that the hospital has sent you to collections.

Statute of Limitations

All states have a statute of limitations for personal injury claims. This is a strict time deadline for when legal action must be taken.

Generally, the statute of limitations for a personal injury claim in Connecticut is 2 years (see Connecticut General Statutes § 52-584). However, the law does allow additional time if the injury is not “discovered or in the exercise of reasonable care should have been discovered” within the time limit. In these latter cases, a personal injury claim can be brought up to 3 years after the date of injury.

Alternatively, some claims are subject to a shorter statute of limitations. Claims against a government agency, for example, must be brought no more than 1 year after the injury occurs (see Connecticut General Statutes § 4-148). In addition, a notice of claim must be provided to the agency. The rules vary, but the time limit for providing a notice of claim varies from just 90 days to 6 months.
